Limited Warranty

Introduction

This Limited Warranty ("Warranty") is provided by Meteor Illumination Technologies, Inc. dba Meteor Lighting ("Meteor" or "Seller") to the original buyer of the Meteor product as identified on Meteor's invoice ("Buyer"). This Warranty applies only to products made by Meteor and sold through Meteor's authorized sales agents and distributors, and is subject to the terms and conditions set forth below.

Subject to the terms of this Warranty, Meteor warrants that eligible products, when delivered in new condition and in their original packaging, shall be free from defects in material and workmanship during the applicable Warranty Period.

If Meteor, in its sole and absolute discretion, determines that a product is defective and eligible for Warranty coverage, Meteor may elect to repair the product, replace the product, or issue a refund or credit for the original purchase price, subject to written approval by Meteor. No refund or credit will be issued unless specifically approved by Meteor in writing.

Meteor's sole obligation under this Warranty is expressly limited to repair, replacement, refund, or credit, as determined by Meteor. In no event shall Meteor's obligation under this Warranty exceed the purchase price paid to Meteor for the specific defective product giving rise to the claim. Incidental, consequential, special, punitive, or exemplary damages are expressly excluded.

Warranty Periods

  • Meteor LED lighting products: five (5) years from the date of shipment.
  • Meteor Solar LED products: three (3) years from the date of shipment.
The Warranty Period begins on the date of shipment of the relevant product from Meteor and shall not be extended by any warranty claim, repair, replacement, refund, or credit.

This Warranty applies only to the original purchaser of the product and/or the first purchaser who is the end user of the product. Meteor is not responsible for auxiliary equipment, third-party products, third-party components, or third-party systems not supplied by Meteor as part of the product.

For LED products, a product shall not be considered defective if the number of inoperable LED components is less than five percent (5%) of the total number of LEDs in the product.

All current and applicable industry standards may be applied when determining whether a product has failed, including, but not limited to, lumen maintenance, color maintenance, diffuser discoloration, finish deterioration, operating conditions, and electrical specifications.

Warranty Claims

To make a Warranty claim, Buyer must notify Meteor in writing within thirty (30) days after discovery or knowledge of the defect or damage.

Buyer must contact Meteor's Tech Support Team at tech@meteor-lighting.com to report the non-compliance and verify Warranty coverage.

No product or component will be accepted for inspection, verification, return, repair, or replacement unless accompanied by a Meteor Return Merchandise Authorization ("RMA") number obtained from an authorized Meteor post-sales or customer service representative prior to return.

Buyer must provide proof of purchase, bill of sale, invoice, or other evidence showing the date of purchase and identification of the original purchaser upon request.

Buyer is responsible for properly packing and shipping returned materials to Meteor. Meteor is not responsible for any damage caused by improper packing, handling, or shipping of returned materials. Buyer shall bear all costs, expenses, and risk of loss associated with shipping products to Meteor for inspection, unless otherwise agreed in writing by Meteor.

If Meteor determines that the returned product is defective and eligible for Warranty coverage, Meteor may, at its sole discretion:
  • Repair the product;
  • Replace the product;
  • Issue a refund or credit for the original purchase price, less applicable freight allowed, commissions paid, or other deductions approved by Meteor in writing.
Meteor may pay for regular ground shipping for any replacement product to the customer if Meteor determines that the product is defective and covered under this Warranty. Any other shipping method, expedited freight, special handling, installation, removal, reinstallation, testing, or evaluation cost is excluded unless specifically approved by Meteor in writing.

Meteor reserves the right to examine the installation site and to inspect, examine, and test all products under a Warranty claim to evaluate proper configuration, design, layout, installation, maintenance, operating history, and usage; determine the cause of failure; and determine Warranty coverage. Failure to comply with Meteor's request for access to the installation site, records, or products may void this Warranty.

Adequate records of operating history, maintenance, and/or testing must be kept by the end user and provided to Meteor upon request to substantiate that the product has failed to comply with the terms of this Warranty.

Terms, Conditions, and Exclusions

This Warranty applies only when the product is used for its intended purpose, installed and operated in accordance with Meteor's instructions and specifications, and used within the electrical values, operating conditions, product classifications, certifications, and ambient temperature range specified by Meteor or shown on the LED driver label.

This Warranty shall not apply to damages, failures, or non-compliance caused by or resulting from:
  • Force majeure, acts of nature, or acts of God;
  • Physical damage, vandalism, fire, power failure, improper power supply, power surges or dips, electrical current fluctuations, or excessive switching;
  • Exposure to adverse, hazardous, corrosive, chemical, or environmental conditions;
  • Use of reactive cleaning agents, harsh chemicals, or improper cleaning methods;
  • Animal or insect activity;
  • Induced vibration or improper structural support;
  • Negligence, misuse, abuse, mishandling, improper use, abnormal use, or unauthorized use of the product;
  • Improper installation, handling, storage, maintenance, service, alteration, or repair;
  • Faulty installation, including poor electrical connections;
  • Failure to comply with supplied instructions, Meteor product specifications, applicable product classifications or certifications, or applicable safety, industry, and electrical standards;
  • Installation and/or operation not in accordance with the National Electrical Code (NEC), applicable federal, state, and local electrical codes, applicable safety standards issued by Underwriters Laboratories (UL), or UL Conditions of Acceptability;
  • Fault or negligence of Buyer, end user, installer, contractor, or any third party not engaged by Meteor;
  • Unauthorized repair, opening, tampering, disassembly, alteration, or modification of the product;
  • Use, integration, compatibility, or operation of the product with third-party products, software, controllers, devices, processes, materials, or components;
  • Failure of third-party supplied components, or failure of Meteor products caused by or associated with third-party supplied components;
  • Substantial deterioration in product finish caused by failure to clean, inspect, or maintain the finish;
  • Any other occurrence beyond Meteor's reasonable control.
This Warranty shall also be void if:
  • Any original Meteor label or marking has been partially or completely removed, covered, or altered;
  • The product has been subject to unauthorized repair, opened, tampered with, taken apart, or otherwise modified;
  • The unit has not been fully paid for, or is otherwise connected with Buyer's breach of Meteor's General Terms and Conditions of Sale;
  • Buyer is in arrears to Meteor;
  • The product is returned without authorization;
  • The product is not used for its intended purpose.
The use of non-Meteor products or components in conjunction with Meteor products may not be covered by UL classification and could be hazardous. Such usage, whether covered by UL classification or not, may void all Meteor product warranties.

If products are used on existing foundations, anchorages, structures, or building conditions, the end user is solely responsible for the structural integrity and suitability of such existing conditions and all consequences arising from their use.

Neither polycarbonate nor acrylic material used in Meteor products is warranted against yellowing, as yellowing may naturally occur over time due to normal aging.

Meteor products are not warranted against costs that may be incurred in connection with changes or modifications required to accommodate site conditions, faulty building construction, faulty design, or other conditions not caused by Meteor.

Third-Party Components

Third-party products or components used in combination with Meteor products, whether provided by Meteor or by another entity, are only covered by their specific manufacturer warranty and are not warranted by Meteor.

Third-party components may include, but are not limited to:
  • Emergency back-up batteries;
  • System controls, including wireless, Bluetooth, PoE, and wired low-voltage controls;
  • Sensors;
  • DMX components;
  • Controllers, software, devices, processes, or materials;
  • Acoustic materials;
  • Wood veneers;
  • Other non-Meteor products or components.

Replacement Products and Parts

For purposes of providing any replacement product or part under this Warranty, Meteor reserves the right, in its sole and absolute discretion, to use new, reconditioned, refurbished, repaired, or remanufactured parts or products. Such parts or products shall be comparable in performance and function to the original product and shall be warranted only for the remainder of the original Warranty Period from the original date of shipment.

No agent, sales representative, distributor, dealer, or other person is authorized to change, modify, or extend the terms of this Warranty on behalf of Meteor unless approved by Meteor in writing.

Disclaimer and Limitation of Liability

Except as expressly stated in this Warranty, Meteor disclaims all other warranties and conditions, whether express, implied, statutory, or otherwise, including, without limitation, any implied warranty of merchantability, fitness for a particular purpose, non-infringement, or any other warranty arising from course of dealing, usage, or trade practice, to the maximum extent permitted by applicable law.

The foregoing Warranty provisions are exclusive and are given and accepted in lieu of any and all other warranties and representations, whether express or implied. Any additional or inconsistent warranty terms included in Buyer's purchasing documents, purchase orders, agreements, or other documents are expressly rejected by Meteor.

To the fullest extent allowed by law, in no event shall Meteor be liable to Buyer, end user, or any third party for any indirect, incidental, consequential, compensatory, special, punitive, or exemplary damages of any kind, including, without limitation:
  • Loss of business;
  • Loss of revenue or profits;
  • Business interruption;
  • Damage to associated equipment;
  • Loss of use of the Meteor product or associated equipment;
  • Cost of substitute products;
  • Costs of removal, disassembly, installation, reinstallation, replacement, testing, evaluation, labor, service, administrative charges, or legal or governmental requirements;
  • Shipping expenses, except as specifically approved by Meteor in writing.
Meteor's total and aggregate liability with respect to any claim of any kind, whether in contract, warranty, tort, negligence, strict liability, or otherwise, arising out of or relating to the sale, delivery, resale, repair, replacement, installation, maintenance, performance, failure, interruption, use, or misuse of any product shall not exceed the purchase price paid to Meteor for the specific defective product giving rise to the claim.

All liability shall terminate upon expiration of the applicable Warranty Period.

To Obtain Warranty Service

In the event that any warranted product fails to comply with this Warranty during the applicable Warranty Period:
  1. Contact Meteor's Tech Support Team at tech@meteor-lighting.com to report the non-compliance and verify Warranty coverage.
  2. Notify Meteor in writing within thirty (30) days after discovery or knowledge of the defect or damage.
  3. Obtain a Meteor Return Merchandise Authorization ("RMA") number before returning any product or component.
  4. Provide proof of purchase, product identification, and any requested installation, operating, maintenance, or testing records.
  5. Follow Meteor's product return procedure and ensure that the RMA number accompanies the returned product.
Meteor reserves the right to inspect the product, review the installation site and operating records, determine the cause of failure, and make the final determination of Warranty coverage.
